Late & Evictions

Procedures

RENT DUE - 1st of the month

Rent is due for all tenants on the 1st of the month regardless of when the lease begins.

LATE - 5th at Midnight

  • 10% Late Fee is applied to all unpaid balances on the 5th of the month at midnight.

  • Late fees are non-refundable

  • Late fees can not be waived for any reason.

EVICTION/JUDGEMENT PROCESS - 10th at Midnight

The system initiates the Eviction/Judgement Process at midnight on the 10th of the month.

  • A $300 Eviction/Judgement Processing Fee is billed to the tenant.

  • This applies to all tenants, even if they have vacated the premises or are in the process of moving out. 

  • The process is can be for possession of the property, financial judgement only, or for both. Example: If someone abandoned a property, the lawsuit will be for a financial judgement for wage garnishments.

  • The process is the same for each type, so the fees associated are the same.

ATTORNEY RETAINER - 13th at Midnight

If the balance is unpaid by midnight on the 13th, the case will be sent to the Eviction Attorney. A retainer fee will be charged to your account. This fee covers only the paperwork filing; any additional costs will depend on the attorney’s further work.​

COURT FILING

  • A few days after the case is forwarded, the attorney will file it with the court.

  • The court filing fees, ranging from $175 to $400, will be billed to your account once they are charged by the court.

  • These fees are due and non-refundable as soon as the case is filed, however it will take a few weeks for the attorney to send us the bill.

  • Once filed, the eviction will remain on your record for 7 years, regardless of the outcome.

PAYING WITHIN 10 DAYS OF COURT

Payments made within 10 days of court must be in cash. This is because checks, debit, and credit card transactions take about 7 days to clear, and we need guaranteed funds to stop an eviction.

COURT DATE

  • If the balance is unpaid by the court date, the eviction will be granted. We have never lost a case.

  • If the balance is paid in full by the court date, the case will be dismissed, and you will not need to vacate.

  • If you contest the case, we will be awarded possession of the property. You will still need to vacate within 10 days. We will return to court in a few weeks to pursue a financial judgment.

SHERIFF (Writ of Possession)

If you have not vacated within 10 days of the judgment date, we will return with the sheriff to remove you and your belongings from the property. ​

TRIAL

If you contest the financial portion of this process, a $500 Trial Fee will be billed to you account to cover the cost of the court appearance.

WAGE GARNISHMENTS

Once we obtain the judgment, we will contact your employer to arrange for wage garnishment. Your employer is legally required to deduct money from your paycheck to satisfy the judgment.

DON'T LET THIS HAPPEN

A judgment will make it difficult to find a reputable landlord for 7 years, and your credit will take years to recover.

Frequently Asked Questions

Can I get a little more time?

The banks do not allow the landlords to skip a mortgage payment, so we can't allow tenants to delay eviction process.

Can I make a partial payment?

Definitely! Pay as much as you can. Your Account Ledger will be reviewed in court. You want to show that you are trying.

How do I stop the eviction process?

The only way to stop the process, is to pay the balance in full. You have some time before the court date so make small payments. They add up!

Who can I talk to about the eviction?

Once the attorney takes over, we are not allowed to speak with the tenant. All questions must be addressed with the evictions attorney.​​
